GEMMA HOLIDAY RENTALS LETTING TERMS AND CONDITIONS

Booking System

  • Bookings are made on behalf of the owner of the property at the prices stated on the Gemma Holiday Rental website. These prices are based on market conditions applicable at the time

2) The client makes their booking by completing the ‘Booking Form’ (e-mailed to them upon conformation of availability)

3) As soon as the client receives the confirmation of their booking, a deposit equal to 25% of the rental price plus an additional 25 EuroBooking fee per Booking must be made

4) The remaining balance must be paid at least 42 days prior to the commencement of the rental period

5) Upon receiving the full balance the client will be sent a ‘Confirmation of Final Balance Received’ letter. For bookings made less than 30 days prior to the start of the rental period, the client must immediately pay the total amount of the rental price.

4) The minimum rental period is generally one week, from Saturday to Saturday.

6) The rental prices are per each accommodation and per week and are sub-divided according to the rental seasons as shown. Gemma Holiday Rentals reserves the right to modify the prices of the houses, in the event of considerable fluctuation with the exchange rates (valid for those countries not using EURO)

7) For any alteration to the booking, or if the client intends to transfer their booking to other persons, on condition that the accommodation and the period do not change, the client has to pay Euro 50.
Gemma Holiday Rentals reserves the right to charge the client any additional cost relative to the booking. Cancellation of a booking, even if it is substituted by another one, the following penalties, in addition to the booking fees and any other additional charges, must be paid:
25% of the total rental price if the cancellation is made between 15 and 30 days before the start of the rental period,
70% of the total rental price if the cancellation is made between 1 and 4 days before the start of the rental period,
100% of the total rental price if the cancellation is made the day of arrival or in the case of no show

Rental Period

1) Arrival and departure - unless otherwise indicated in the description of the property, arrival/departure must take place on Saturday at the following hours:

Arrival between 5 pm and 8 pm
for the latter the client must inform Gemma Holiday Rentals of the exact time of arrival at the time of booking or subsequently thereof, so that the owner or their representative can meet the client at the agreed location (in the event that the client fails to inform Gemma Holiday Rentals of the exact time of arrival then the following arrival time will be advised to the owner: 6.30 p.m.); the owner or their representative will wait for the client for no longer than one hour from the advised arrival time.
Departure between 8 am and 10 am
Changes to the arrival date and arrival time must be agreed and approved by Gemma Holiday Rentals at least 3 days in advance. In the case of unavoidable delay on the day of arrival, the client must call Gemma Holiday Rentals between 4 pm and 8 pm – Tel +393387112973 .
If the owner or their representative are not available and it is not possible to inform the owner or their representative of a late arrival, in the event that the late arrival was not previously agreed and approved or in the event that the owner cannot accept a late arrival, the client alone is responsible for the cost of any overnight stay in paid accommodation (hotel, etc.). The owner or their representative who is then obliged to make an unplanned displacement to the property is entitled to claim from the client the reimbursement of their expenses

2) Upon arrival - the client must present their ‘Confirmation of Final Balance Received’ letter as well as their passports or identity card to the owner or their representative to enable them to proceed with their registration in accordance with legal requirements

3) Security deposit - when the keys are handed over to the client, the security deposit, as stated on Gemma Holiday Rentals website within the description of the property must be paid, in CASH and in EUROs to the owner or their representative. This amount will be refunded at the end of the holiday less any deduction made for damage caused to the property or for any additional costs that were not included in the rental price. THE OWNER OR THEIR REPRESENTATIVE CAN REFUSE ACCESS TO THE PROPERTY IF THE SECURITY DEPOSIT IS NOT HANDED OVER. In the event of any damages Gemma Holiday Rentals reserves the right to charge the client the relative amount. Should the client decide to leave the property prematurely the owner or their representative are authorised to refund the deposit to the client by post (less any deductions for damages or any additional expenses) and only after having checked the inventory and the property in question. Gemma Holiday Rentals declines all responsibility in the event of a dispute between the client and the owner regarding the deposit

4) Approved clients - only those persons whose name appears on the Booking Form and whose presence has been registered with the authorities may use the property. The number of persons (adults and children) must not exceed the number of sleeping places as indicated in the advertised property on Gemma Holiday Rentals website. This does not apply to infants (up to 2 years old) provided that the client brings a travel cot and its relevant bed-linen. Any other exceptions are stated in the property description. The substitution of persons during the rental period is forbidden unless previously agreed upon with Gemma Holiday Rentals

5) Cleaning - the properties will be handed over clean and tidy and in good working order. The client is obliged to hand over to the owner or their representative the amount due, in EUROs (if shown on Gemma Holiday Rentals website or in the description of the property) for the cleaning of the property. This amount does not however include the cleaning of the kitchen corner/the kitchen/the kitchenette and the removal of rubbish which are the client’s responsibility. If this has not been undertaken, the owner or their representative is obliged to charge an additional expense in addition to the amount due.
The client must leave the property clean and tidy if the property is checked prior to departure then the security deposit will be returned immediately (less any cost of cleaning or damages). If the property has not been checked prior to departure and the property then the security deposit will be returned within 14 days of departure. In the case of any damage to the property the client must reimburse the vendor directly, Gemma Holiday Rentals is not responsible for retrieving the cost of damages from the client.

6) Heating - The cost of heating, if based upon usage, must be paid directly to the owner or their representative before departing

7) External maintenance - the owner or their representative reserve the right to have free access to the property for essential maintenance purposes (garden, swimming-pool etc...).

Responsibilities
Gemma Holiday Rentals have visited and checked each property. The descriptions appearing on our website are accurate and have been prepared in good faith. Gemma Holiday Rentals, however, declines all responsibility for any modifications made by the owners without our knowledge, unless it is impossible to totally or partially fulfil the contract and that the client will not accept the partial fulfilment of the contract. In the event of any problems, the client undertakes to do their best to resolve or minimise them in order to avoid any prejudices that could result.
If the client is unable to do this, they must immediately contact Gemma Holiday Rentals by telephone on the Saturday evening of their arrival (between 4 pm and 8 pm - Tel. +393387112973) or by no later than the following Monday evening (10am to 12 noon and from 3 pm to 7 pm), and confirm their complaints in writing within 24 hours by fax (+39034454787) or by e-mail (info@gemmaholidayrentals.co.uk or info@gemmaimmobiliare.com ). The client is obliged to give Gemma Holiday Rentals the time necessary to resolve the problem. Should there be no written complaint supplied as above specified and without an explicit authorisation by Gemma Holiday Rentals, the client who leave their accommodation prematurely forfeit their rights for a refund of the rental price, unless there is a legal right for them to have cancelled. Complaints received at the end of the stay will not be taken into consideration and no refunds will be given.
If, for any reason beyond its control including force majeure, Gemma Holiday Rentals has to cancel the booking made by the client, Gemma Holiday Rentals, in agreement with the client, will offer the client another property of equivalent standard, provided that Gemma Holiday Rentals are able to provide this alternative. If the price of the alternative property is less, the difference will be reimbursed to the client by Gemma Holiday Rentals.
In the event that an agreement cannot be reached, both parties can retract from the contract. Gemma Holiday Rentals will reimburse the client for the cost received for the rental period and any other reimbursements are excluded

 Law and Jurisdiction

The Letting Terms and Conditions and parts therein is subject to Italian Law under the jurisdiction of the Court of Como.

Completion the ‘Booking Form’ implies that Gemma Holiday Rentals Letting Terms and Conditions have been read and understood and have thereby been accepted without reservation and without exception. If any of the conditions of this contract have become invalid or were invalid other conditions cannot be contested

And finally……

The properties that Gemma Holiday Rentals offer are not official tourist facilities, such as hotels, residences, etc. but private houses. As such, they may reflect, local traditions and the personal taste of the owners, which is precisely the type of holiday rental that Gemma Holiday Rentals specializes in, it is important that clients not only accept but will also be able to embrace the differences in the properties Gemma Holiday Rentals offers in comparison with those where the client normally lives. Gemma Holiday Rentals recognises that these differences attributable to the special nature of architecture and traditions of the area can sometimes result in minor inconveniences these however, cannot be accepted as complaints.
